1. Introduction & Acceptance of Terms
1.1. Welcome to QuranRecord
Thank you for choosing the QuranRecord application.
QuranRecord is developed with a singular, noble intention: to meticulously monitor and analyze the Quran recitation and memorization progress of students. Our unique approach is designed to holistically support the entire educational ecosystem by focusing on the three most critical pillars: school management, teachers, and parents. We are committed to overcoming the challenges and limitations inherent in traditional methods of Quranic education.
QuranRecord serves as a dedicated digital companion for private teachers, family study groups, schools, mosques, madrassas, and every other institution entrusted with the sacred duty of teaching the Holy Quran. As we continue to evolve, the platform has expanded beyond simple recording. We are constantly integrating new modules to support virtually every administrative and educational activity within Quranic studies institutions, creating a seamless and comprehensive management solution.
We firmly believe in making Quranic education accessible to all. Therefore, QuranRecord is provided free of charge. We do not collect any fees from parents, students, or educational institutions. Furthermore, our commitment to a pure, focused learning environment means we strictly prohibit advertisements, promotional images, videos, and all forms of social media integration. Your experience is solely about the Quran, your progress, and your connection with the divine words—supported by QuranRecord.
QuranRecord is a service provided by Fedri Consulting Services Ltd., a corporation incorporated under the laws of Canada.
1.2. Binding Agreement
By downloading, accessing, or using the QuranRecord application ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which are incorporated herein by reference. If you do not agree to these terms, you may not access or use the Service. These terms constitute a legally binding agreement between you and Fedri Consulting Services Ltd. ("QuranRecord," "we," "us," or "our").
1.3. Eligibility and Supervised Use
The QuranRecord application is designed to be a safe and beneficial tool for learners of all ages. However, due to the nature of the data we collect the creation of an independent user account is restricted to individuals aged 13 and older.
For Users Under the Age of 13 ("Children"):
Children may access and use the QuranRecord service only under the direct supervision of a parent, guardian, or authorized teacher who manages the account. The account holder is solely responsible for:
- All activities that occur under their account, including those performed by any Children they supervise.
- Ensuring that the use of the Service by a Child complies with these Terms.
- Providing any necessary consents for the collection of the Child's audio recordings and data as outlined in our Privacy Policy.
By creating an account or allowing a Child to use the Service under your account, you represent and warrant that you are either:
a) 13 years of age or older and have the legal capacity to agree to these Terms, or
b) The parent or legal guardian of a Child user and you agree to be bound by these Terms on the Child's behalf.
1.4. Modifications to the Terms
a. Right to Modify.
Fedri Consulting Services Ltd. ("We," "Us," "Our") reserves the sole and absolute right to modify, amend, or update these Terms of Service, our Privacy Policy, and any other policies incorporated herein at any time and for any reason. We may make these changes to reflect updates to our Service, changes in our business practices, to ensure compliance with applicable laws and regulations, or for any other purpose we deem necessary.
b. Notification of Material Changes.
We are committed to transparency regarding changes that affect your rights and obligations. In the event we make a material change to these Terms, we will provide you with prominent notice before the change becomes effective. Methods of notification may include, but are not limited to:
- Displaying a clear and conspicuous notice within the QuranRecord application upon your login.
- Sending a communication to the email address associated with your account.
- Posting a summary of the changes on our official website or blog.
The method of notification shall be at our sole discretion. "Material changes" are changes that significantly reduce your rights or increase your responsibilities. This may include, for example, significant changes to fees (if ever introduced), data handling practices, or dispute resolution procedures.
c. Effective Date of Changes.
Unless otherwise stated in our notice, all non-material changes to the Terms will be effective immediately upon posting within the application or on our website. For material changes, we will provide at least thirty (30) days' notice prior to the effective date of the change. This gives you adequate time to review the new terms.
d. Your Acceptance of Changes.
Your continued use of the QuranRecord Service after the effective date of any modified Terms constitutes your complete and unconditional acceptance of those new Terms. You agree that this continued use represents your affirmative action of agreeing to be bound by the modified terms.
e. Objection to Changes.
If you do not agree to any modified Terms, your sole and exclusive remedy is to discontinue using the Service and terminate your account. You can terminate your account by following the instructions within the application settings or by contacting us directly.
f. Reviewing the Terms.
You are responsible for periodically reviewing the most current version of the Terms of Service. The "Last Updated" date at the top of this document will indicate the latest revision. You can access the current Terms at any time within the application's settings menu or on our website.
2. Description of Service
2.1. What is QuranRecord?
QuranRecord is a comprehensive digital ecosystem designed to modernize and enhance the management of Quranic education. Developed after extensive research in mosques and Quran schools, our platform addresses the significant gaps and inefficiencies inherent in traditional, paper-based systems for tracking student recitation and memorization.
The Problem: Limitations of Traditional Methods
Traditional methods, such as handwritten marks in Qurans or logbooks, often suffer from a lack of centralized records, inconsistent tracking, and difficulty in analyzing student progress. These systems make it challenging to retrieve historical data, involve parents, identify students who are struggling or excelling, and generate meaningful performance analytics.
The Solution: A Structured Digital Management System
QuranRecord solves these challenges by providing a structured, professional, and centralized platform that ensures clarity, consistency, and active involvement from all stakeholders: school administration, teachers, and parents.
2.2. Key Features and Services
The QuranRecord Service includes, but is not limited to, the following features:
- MySchool: A complete school management system providing dedicated portals for administrators, teachers, and parents to access and manage all student activities.
- FamilyHub: A dedicated portal for parents to view their child's recitations, monitor attendance in real-time, review and complete assigned homework, and stay fully engaged with their child's progress.
- Notifications: Instant automated alerts sent via email, SMS, and in-app notifications to keep parents informed of their child's activity, attendance, and important updates.
- Records: An efficient digital logging system allowing teachers to record Quran or Qaidah recitations (by lesson, repetition, and revision) in a globally recognized format within seconds.
- Downloads: The ability to filter and download records by Juz, chapter, or other criteria, exporting them as detailed, official PDF reports for record-keeping and analysis.
- Attendance: A digital tool to take and manage student attendance, with automatic notifications to parents for absences or specific remarks.
- MissingRecord: An automated monitoring system that alerts management, teachers, and parents if a student's daily recitation record is missing, ensuring accountability.
- Calendar: A centralized calendar to manage and communicate school schedules, holidays, events, and working days to staff and parents.
- Jurisdiction: A scalable dashboard for administrators to easily oversee and manage activities across multiple schools or branches from a single, unified login.
- PrivateGroup: The ability for private tutors or families to create dedicated groups to track and analyze the Quranic progress of their students or members outside of a formal school structure.
- Unlimited Access: QuranRecord is committed to accessibility, offering unlimited controllers, teachers, students, classes, user accounts, and records without restriction.
- AlwaysFree: In support of our mission to serve Quranic education, the core services of QuranRecord are offered free of charge to students, parents, and institutions.
2.3. Service Limitations and Disclaimers
While we strive to provide a reliable and continuous service, you acknowledge and agree that:
- The QuranRecord Service is provided "as is" and "as available."
- We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
- The availability and functionality of the Service are dependent on your internet connection and device compatibility.
- We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
- The content of the Quranic text itself is sacred and immutable; QuranRecord provides a platform for managing the recitation of this text and does not claim any ownership or authority over the divine content.
2.4. Evolution of the Service
QuranRecord is a dynamic platform committed to continuous improvement and innovation. We regularly develop and release new features, tools, and enhancements to better serve our community.

It is your responsibility to periodically review this page to stay informed about the full scope and capabilities of the Service. By continuing to use QuranRecord, you acknowledge that the Service is subject to change and that you accept any such new features, which will also be governed by these Terms.
3. Privacy Policy
3.1. Information We Collect
We collect information that you provide directly to us and information about your use of the Service through automated means. The types of information we collect are detailed below.
A. Personal Information Provided by You or Your Institution
This is information that can be used to identify you or the student ("Personal Information"). This information is provided voluntarily, typically by a school administrator or teacher during the account setup and management process.
Minimum Required Data: To provide the core functionality of the Service, the only Personal Information strictly required by QuranRecord is:
- Student Name: Required to display student information, track progress, and attribute records within the system.
- User Email Address: Required for account creation, login, and essential service communications for teachers and administrators.
- Password: Securely hashed and stored for account authentication.
Optional Data: Educational institutions (Schools, Mosques, Madrassas) using our Service may choose to collect and store additional Personal Information based on their own administrative and educational requirements. QuranRecord does not mandate the collection of this data. The institution is the data controller for this optional data, and its collection and use are governed by the institution's own privacy practices. This optional data may include, but is not limited to:
- Parent or guardian names, contact numbers, and email addresses.
- Student age, grade level, or class name.
- Additional student identifiers or information deemed necessary by the institution.
- Your Consent: By providing this optional information to the institution, you consent to its storage and processing within the QuranRecord system as directed by the institution.
B. Recitation and Progress Data (Core Service Data)
This is non-personal, metadata related to the educational activity performed on the platform.
What We Collect: We collect and store data generated by the use of our logging tools. This data is strictly limited to textual metadata and includes:
- Chapter (Surah) number and name.
- Verse (Ayah) range.
- Type of activity (e.g., Lesson, Repetition, Revision).
- Date, time, and duration of the recitation session.
- Teacher notes or ratings entered into the system.
- Performance tags and progress markers.
What We Do NOT Collect:
- Audio Recordings: QuranRecord does not record, process, or store any audio data of student recitations on its servers.
- Video or Photographs: QuranRecord does not collect or store any video recordings or photographs of users on its servers.
Institution-Hosted Audio: If an educational institution wishes to incorporate audio recordings, it must host and manage those files on its own third-party cloud storage service (e.g., Google Drive, AWS S3, etc.). The institution may then store a hyperlink to that externally hosted file within the QuranRecord platform. QuranRecord is not responsible for the privacy, security, or management of any audio data hosted externally by the institution.
C. Technical and Usage Data (Automatically Collected Information)
When you access our Service, we automatically collect certain information about your device and usage patterns.
- Log Information: We collect standard server logs, which may include your Internet Protocol (IP) address, device and browser type, operating system, referring web pages, pages visited, and the dates and times of each access.
- Usage Data: We collect information about your interactions with the Service, such as the features you use, the time spent on those features, and other statistics about your activity. This data is aggregated and anonymized where possible to analyze overall service performance and trends.
3.2. How We Use Your Information
The information we collect is used strictly for the purposes outlined in this Policy and in accordance with the following provisions. By using the QuranRecord Service, you expressly consent to the processing of your information for these specified and legitimate purposes.
A. Provision and Maintenance of the Core Service
- Purpose: We use your Personal Information, specifically your name and account credentials, to create and secure your unique user profile, authenticate your logins, and provide you with access to the QuranRecord platform. Recitation Data (chapter, verse, tags) is processed to create, display, and maintain a historical record of student progress, which is the fundamental purpose of the Service.
- Legal Basis: Processing is necessary for the performance of the contract (these Terms of Service) between you and Fedri Consulting Services Ltd.
- Data Handling: All data integral to the Service is stored securely on our encrypted databases. We implement a rigorous backup protocol to ensure data integrity and availability. These backups are essential for disaster recovery and business continuity and are themselves subject to the same security standards as our primary databases.
B. Personalization of User Experience
- Purpose: We use your activity data (e.g., frequently accessed features, user role) to tailor the interface and functionality of the Service to your role (Administrator, Teacher, Parent, Student). This may include pre-populating forms, displaying relevant student lists, or customizing dashboard views.
- Legal Basis: This processing is necessary for our legitimate interests in improving the usability and efficiency of our Service, thereby enhancing the user experience for all our customers.
C. Service Analysis and Feature Improvement
- Purpose: We use aggregated, anonymized Technical and Usage Data to analyze trends, monitor service performance, track feature adoption, understand user engagement, and diagnose technical issues. This analysis is conducted on a generalized level and is not used to create profiles of individual users.
- Legal Basis: This processing is necessary for our legitimate interests in developing and improving our Service, ensuring its stability, and making informed decisions about future features and resource allocation.
D. Communication with Users
- Service-Related Communications: We use your contact information, primarily your email address, to send you essential, non-promotional communications related to the Service. This includes, but is not limited to:
- Account registration confirmations and security alerts (e.g., login from a new device).
- Critical notices regarding the Service, such as scheduled maintenance, security patches, or changes to these Terms or the Privacy Policy.
- Responses to your support inquiries and requests.
- Legal Basis: Processing for these purposes is necessary for the performance of our contract with you and for our legitimate interest in providing effective customer support and communicating essential service information.
- Promotional Communications: QuranRecord does not engage in direct marketing or promotional communications. We will not use your Personal Information to send you newsletters, marketing emails, or any material promoting third-party products or services.
E. Security, Fraud Prevention, and Legal Compliance
- Purpose: We use your Information, including IP address and account activity logs, to:
- Monitor and analyze activity for the purpose of preventing, detecting, and investigating security incidents, fraudulent or illegal activity, and unauthorized access to or use of the Service.
- Protect the rights, property, and safety of Fedri Consulting Services Ltd., our users, and the public.
- Enforce our Terms of Service and other policies.
- Comply with applicable laws, regulations, legal processes, or governmental requests.
- Legal Basis: This processing is necessary for our compelling legitimate interests in protecting our Service and users from harm, and for compliance with our legal obligations.
Data Processing Limitations: We will not use your Information for any purpose other than those outlined in this Section 3.2 without notifying you and, where required by law, obtaining your explicit consent. We do not sell, rent, or lease your Personal Information to any third parties. We do not use your Information for automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.
3.4. Data Retention
A. Retention Period: Fedri Consulting Services Ltd. will retain your Personal Information and Recitation Data only for as long as is necessary to fulfill the purposes for which it was collected, including to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.
- Active Accounts: For as long as your account is active and you are using the Service, we will retain your data to provide the functionality of QuranRecord.
- Terminated Accounts: Upon termination or deactivation of your user account by you or your educational institution, we will initiate a process to delete or anonymize your Personal Information and Recitation Data from our active production databases. This process will be completed within a maximum of ninety (90) days.
- Backup Data: Please note that due to the nature of our backup and disaster recovery systems, residual copies of your data may persist in our secure, encrypted backup archives for a longer period, up to a maximum of one (1) year, after which they are automatically and permanently purged. These backups are not available for routine access and are used solely for data recovery in the event of a catastrophic system failure.
B. Deletion Requests: You have the right to request the deletion of your Personal Information. You may initiate this request by deleting your account through the application settings or by contacting us directly at https://www.quranrecord.com/support/. Please note: If your data is managed by an educational institution, you must typically make your deletion request directly to that institution's administrator.
3.5. Data Security
We implement and maintain comprehensive technical and organizational security measures designed to protect your Information from unauthorized access, destruction, use, modification, or disclosure.
- Encryption in Transit: All data transmitted between your device and the QuranRecord servers is encrypted using strong, industry-standard Transport Layer Security (TLS) protocols.
- Encryption at Rest: All Personal Information and sensitive data, including Recitation Data, is encrypted while stored on our servers using robust encryption algorithms.
- Secure Infrastructure: Our service is hosted on secure server infrastructure provided by industry-leading cloud providers, which implement stringent physical security and environmental controls.
- Access Controls: Access to our systems and databases is strictly limited on a need-to-know basis to a small number of authorized personnel and is protected by strong authentication mechanisms, including multi-factor authentication (MFA). All access is logged and audited regularly.
- Security Disclaimer: Despite our rigorous efforts, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Information, we cannot guarantee its absolute security. In the event of a data breach that affects your Information, we will comply with all applicable laws regarding notification.
3.6. Children's Privacy
QuranRecord is committed to complying with the Children's Online Privacy Protection Act (COPPA) in the United States and the General Data Protection Regulation (GDPR) as it pertains to children in the European Union.
- Restriction on Independent Use: The Service is not offered for independent use by children under the age of 13 ("Child" or "Children"). QuranRecord does not knowingly collect Personal Information directly from Children.
- Institution-Led Use: Children may access the Service solely under the supervision and through the account of a parent, guardian, or an authorized educational institution. The institution or parent is responsible for providing all necessary information and is deemed to have obtained any verifiable parental consent required by law.
- Parental Rights: Parents or guardians who believe their Child has submitted Personal Information to us through an institution and wish to have it deleted may contact us at [insert dedicated email]. We will require you to verify your identity and your relationship to the Child before processing the request.
4. User Accounts & Responsibilities
4.1. Account Creation and Information Accuracy
To create a user account on QuranRecord, you must provide accurate and complete information as requested during the registration process. The minimum required information strictly necessary for account creation is:
- First Name
- Last Name
- Valid Email Address
- Gender
You represent and warrant that all information provided during registration is accurate, current, and complete. You agree to update this information promptly should any changes occur.
Important Notice on Additional Data: Your educational institution (e.g., school, mosque, madrassa) may require and input additional personal information about you (such as contact details, Parents Name, or student ID) into the QuranRecord system to fulfill their administrative and educational responsibilities. QuranRecord is not the controller of this data. The collection and use of such additional information are governed solely by your institution's privacy policy and practices. You must direct any inquiries regarding this data directly to your institution.
4.2. Account Security
You are solely and entirely responsible for maintaining the confidentiality of your account credentials, including your password. You are further solely and entirely responsible for any and all activities that occur under your account, whether authorized by you or not.
You agree to:
- Immediately notify QuranRecord of any unauthorized use of your account or any other breach of security.
- Ensure that you fully exit from your account at the end of each session.
- Use a strong and unique password for your QuranRecord account.
QuranRecord shall not be liable for any loss or damage arising from your failure to comply with these security obligations.
4.3. User Conduct and Prohibited Activities
You agree to use the QuranRecord Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all conduct and content associated with your account. You expressly agree not to engage in, and strictly prohibit, the following activities:
- Illegal or Fraudulent Activity: Using the Service for any unlawful purpose or to solicit the performance of any illegal activity.
- Harmful Code: Uploading, transmitting, or introducing any material that contains viruses, Trojan horses, worms, logic bombs, or any other malicious or technologically harmful code or material.
- Security Violations: Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
- Spam and Unsolicited Communications: Using the Service to send, receive, or facilitate unsolicited commercial communications (spam).
- Impersonation and Misrepresentation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Infringing Content: Uploading, recording, or sharing any content that infringes upon any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any party.
- Objectionable Content: Uploading, recording, or sharing any content that is defamatory, obscene, pornographic, vulgar, offensive, promotes violence or hatred, or is otherwise objectionable in QuranRecord's sole discretion.
- Non-Quranic Use: Using the recording or logging functionality for any content other than Quranic recitation or related educational purposes (e.g., Qaidah). The Service is not to be used for recording music, personal conversations, or any other non-authorized audio content.
Any violation of these conduct rules may result in the immediate suspension or termination of your account at QuranRecord's sole discretion.
4.4. Content Ownership and License
A. Ownership of Records:
You retain all ownership rights to the Recitation Data (the textual metadata of chapter, verse, and tags) that you create and upload to the Service.
B. License Grant to QuranRecord:
By creating and uploading Recitation Data to the QuranRecord Service, you hereby grant Fedri Consulting Services Ltd. a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, process, and display such Recitation Data only to the extent necessary to:
- Provide, maintain, and secure the QuranRecord Service for you and your designated recipients (e.g., your teacher, parent, or school).
- Debug, improve, and develop new features and functionality for the Service.
- Perform internal testing, analysis, and research on aggregated and anonymized datasets to enhance the accuracy, performance, and quality of our services. This internal use is strictly confined to improving QuranRecord and will not be used for any independent commercial purpose unrelated to the Service.
This license terminates automatically upon your deletion of the specific Recitation Data or the termination of your account, except to the extent that copies of anonymized data remain in our backup systems for the duration of the retention period outlined in Section 3.4.
C. License Grant from QuranRecord to You:
The QuranRecord application, including its design, software, logos, and all other intellectual property, is the exclusive property of Fedri Consulting Services Ltd. and its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use.
5. Intellectual Property
5.1. QuranRecord's Intellectual Property Rights
Fedri Consulting Services Ltd. exclusively owns and shall retain all right, title, and interest, including all related intellectual property rights, throughout the world, in and to the QuranRecord application, platform, and all related services, including but not limited to:
- All source code, object code, software, databases, algorithms, APIs, and underlying technology.
- The QuranRecord name, logo, all related names, logos, product and service names, designs, and slogans are trademarks of Fedri Consulting Services Ltd. or its affiliates or licensors.
- The entire content of the Service, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, design, structure, selection, coordination, expression, "look and feel," and arrangement thereof, is owned, controlled, or licensed by or to Fedri Consulting Services Ltd., and is protected by copyright, patent, trademark, and other intellectual property rights and unfair competition laws.
No right, title, or interest in or to the Service or any content on the platform is transferred to you, and all rights not expressly granted are reserved by Fedri Consulting Services Ltd.
5.2. The Sacred Quranic Text
QuranRecord expressly disclaims any and all ownership, copyright, or intellectual property rights in the sacred text of the Holy Quran. The Quran is the divine revelation of Allah (God) and its text is immutable and eternal. QuranRecord functions solely as a digital platform providing access to and tools for engaging with this sacred text for educational and religious purposes. The Company makes no claim of authorship, alteration, or ownership of the Quranic content itself.
6. Disclaimer of Warranties & Limitation of Liability
6.1. Service "As Is" and "As Available"
THE QURANRECORD SERVICE AND ALL INCLUDED CONTENT ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. FEDRI CONSULTING SERVICES LTD. EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT THE RESULTS OBTAINED FROM USE WILL BE ACCURATE OR RELIABLE; OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
6.1.1. Data Loss Disclaimer
NOTWITHSTANDING ANY OTHER PROVISION, FEDRI CONSULTING SERVICES LTD. SHALL BEAR NO RESPONSIBILITY OR LIABILITY FOR ANY LOSS, CORRUPTION, OR UNAVAILABILITY OF ANY DATA, INCLUDING BUT NOT LIMITED TO RECITATION DATA AND PERSONAL INFORMATION, WHETHER RESULTING FROM SOFTWARE FAILURE, SERVER MALFUNCTION, NETWORK OUTAGE, CYBER-ATTACK (INCLUDING RANSOMWARE OR HACKING), HUMAN ERROR, ACTS OF GOD, FORCE MAJEURE, OR ANY OTHER CAUSE BEYOND OUR REASONABLE CONTROL, IRRESPECTIVE OF THE STRINGENCY OF THE SECURITY AND BACKUP SYSTEMS WE HAVE IN PLACE. USERS ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT BACKUP COPIES OF THEIR CRITICAL DATA.
6.2. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEDRI CONSULTING SERVICES LTD., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
7. Termination
7.1. Termination by You
You may terminate your account and this agreement at any time for any reason by deactivating your account through the account settings interface within the QuranRecord application or by submitting a deletion request via Support.
7.2. Termination by QuranRecord
We may, in our sole discretion, suspend or terminate your account and your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to if you breach any provision of these Terms. Upon any such termination, your right to use the Service will cease immediately.
7.3. Effect of Termination
- Your right to access and use the Service will terminate immediately.
- All licenses granted to you under these Terms will terminate.
- The provisions of these Terms that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnities, and limitations of liability) shall survive.
- Your Personal Information and Recitation Data will be handled in accordance with our Data Retention policy outlined in Section 3.4. Residual data may persist in encrypted backups for the defined retention period before final purging.
8. Governing Law & Dispute Resolution
8.1. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement.
8.2. Agreement to Arbitrate; Waiver of Class Action
- Mandatory Arbitration of Disputes: You and Fedri Consulting Services Ltd. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the QuranRecord Service (collectively, “Disputes”) will be settled by binding arbitration, rather than in court. This agreement to arbitrate includes any claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
- Waiver of Jury Trial and Class Actions: YOU AND FEDRI CONSULTING SERVICES LTD. HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. Arbitration will be on an individual basis; class arbitrations and class actions are not permitted.
- Arbitration Rules and Governing Law: The arbitration will be administered by the Canadian Arbitration Association (CAA) or another mutually agreed alternative dispute resolution provider. The arbitration shall be conducted according to the Arbitration Act, 1991 (Ontario), seated in Toronto, Ontario, and conducted in English.
- Exceptions to Arbitration: Each party retains the right to bring an individual action in small claims court and to seek injunctive or equitable relief to prevent infringement or violation of intellectual property rights.
